The Guidelines for Approved NSW School Providers Delivering Courses to Overseas Students (‘the Guidelines’) have been amended in response to revised Commonwealth legislation. The new legislation is:

• The Education Services for Overseas Students Legislation Amendment (Tuition Protection Services and Other Measures) Act 2012
• The Education Services for Overseas Students (Registration Charges) Amendment (Tuition Protection Service) Act 2012
• The Education Services for Overseas Students (TPS Levies) Act 2012.

The changes to the Guidelines relate to:

• the introduction of the Tuition Protection Scheme for all registered providers to replace the Tuition Assurance Membership (section 3.3 of the Guidelines)
• strengthened record keeping obligations in relation to regular updating of student contact details (section 3.9 of the Guidelines)
• limiting the amount of pre-paid tuition fees collected by a provider prior to and, after commencement, before the second study period (section 3.9 of the Guidelines)

These changes take effect from the publication of this Official Notice.

The amended Guidelines are available to download from the Schools with Overseas Students (CRICOS) section of the Board’s website.
